MISUJI Co., Ltd. (hereinafter referred to as “the Company”) has established the following privacy policy (hereinafter referred to as “this Policy”) regarding the handling of personal information of those who use the Company’s services (hereinafter referred to as “Users”). This Policy aims to promote the protection of personal information by building a system for personal information protection, ensuring that all employees understand the importance of personal information protection and implementing it thoroughly.
1 (Personal Information)
“Personal Information” refers to the information defined as “personal information” under the Act on the Protection of Personal Information (Act No. 57 of 2003, hereinafter referred to as the “Personal Information Protection Act”). This includes information related to a living individual that can identify a specific individual through details such as name, date of birth, or personal identification codes.
2 (Purpose of Use of Personal Information)
The Company acquires and uses personal information of Users within the scope necessary for the following purposes. If the Company intends to use personal information beyond these purposes, it shall obtain the User’s consent in advance through appropriate means.
(1) To provide the Company’s services (hereinafter referred to as “the Service”)
(2) To improve and enhance the Service content or develop new services
(3) To provide information on new features, updates, promotions, and other services offered by the Company (including email, leaflets, and other direct mail)
(4) To contact Users for necessary maintenance or important notifications
(5) To respond to User inquiries, opinions, etc., regarding the Service (including identity verification)
(6) To report on the usage of the Service to Users
(7) To request User cooperation in surveys or interviews related to the Service or to invite participation in various events and report the results
(8) To investigate and analyze usage history of the Service and use the results to improve, develop the Service, and deliver advertisements
(9) To provide personal information to partner companies participating in Company-hosted events based on User consent or application
(10) To identify and refuse usage by Users who violate the Terms of Use or attempt to use the Service for illegal or improper purposes
3 (Use of Cookies, etc.)
(1) The Company uses technology such as cookies and other information collection modules (hereinafter referred to as “Cookies, etc.”) to analyze access to the Service and collect access and browsing information of Users. Information obtained through Cookies, etc. (hereinafter referred to as “Cookie Information”) does not include information that can independently identify the User.
(2) Users can configure settings regarding the use of Cookies, etc., on the Service. If Users choose not to allow Cookies, etc., they can disable them in their browser settings. However, disabling Cookies, etc., may affect the convenience of the Service or limit the range of services available.
(3) The Company utilizes Cookie Information for purposes such as the operation, quality maintenance, and improvement of the Service, as well as the development and improvement of the Company’s products and services and the delivery of advertisements tailored to the User’s Service usage.
4 (Management and Protection of Personal Information)
Personal information will be managed strictly, and without the User’s consent, it will not be disclosed or provided to third parties except in the following cases. Furthermore, considering safety, the Company will take preventive and corrective measures against risks such as unauthorized access, loss, destruction, falsification, and leakage of personal information.
(1) When necessary for the protection of a person’s life, body, or property, and obtaining User consent is difficult
(2) When particularly necessary to promote public health or the sound development of children, and obtaining User consent is difficult
(3) When it is necessary to cooperate with a national or local public body or a party entrusted with performing duties prescribed by law, and obtaining User consent may interfere with the execution of said duties
(4) In other cases permitted by law
5 (Outsourcing of Personal Information Handling)
The Company may outsource all or part of the handling of personal information within the scope necessary to achieve the purposes of use. In such cases, the Company will conduct a sufficient review of the contractor’s suitability and will stipulate matters related to confidentiality obligations in the contract, ensuring appropriate supervision of the contractor.
6 (Shared Use of Personal Information)
The Company may share User personal information within the scope necessary to achieve the purposes of use as follows:
- Purpose of Shared Use: For service management and improvement
- Scope of Shared Personal Information and Shared Users: MISUJI Co., Ltd.
- Person Responsible for the Management of Personal Information: MISUJI Co., Ltd. (Representative: President Kakuto Katoji)
7 (Disclosure of Personal Information)
Users may request the disclosure of personal information held by the Company by following the procedures specified in Article 10. Upon receiving such a request, the Company will disclose the information to the User without delay. However, if disclosure falls under any of the following circumstances, the Company may choose not to disclose all or part of the information. In such cases, the Company will promptly notify the User of its decision not to disclose.
(1) When there is a risk of harm to the life, body, property, or other rights and interests of the User or a third party
(2) When it may significantly hinder the proper conduct of the Company’s business
(3) When it may result in a violation of other laws and regulations
8 (Correction of Retained Personal Data)
(1) If a User believes that personal information held by the Company is incorrect, they may request correction, addition, or deletion of the information (hereinafter referred to as “correction, etc.”) by following the procedures specified in Article 10.
(2) Upon receiving the above request, the Company will promptly conduct the necessary investigation. If it determines that the request is justified, the Company will promptly make the correction, etc., to the personal information.
(3) The Company will promptly notify the User of its decision regarding whether to implement the correction, etc., based on the previous item.
9 (Suspension of Use of Personal Information, etc.)
(1) Users may request the suspension, deletion, or cessation of provision to third parties of their personal data held by the Company (hereinafter referred to as “suspension of use, etc.”) by following the procedures specified in Article 10.
(2) Upon receiving such a request, the Company will promptly conduct the necessary investigation. If it determines that the request is justified, the Company will implement the suspension of use, etc. However, if the suspension of use, etc., incurs high costs or is otherwise challenging, the Company will take alternative measures necessary to protect the User’s rights and interests.
(3) The Company will promptly notify the User of its decision regarding whether to implement the suspension of use, etc., based on the previous item.
10 (Procedures for Disclosure, etc., of Personal Information)
If Users wish to make requests specified in Articles 7 to 9, they should complete the required items on the application form specified in (1) below and submit it, along with the identity verification documents specified in (2), to the destination specified in (3).
11 (Procedures for Changes to the Privacy Policy)
The Company will periodically review and strive to improve the content of this Policy. The content of this Policy may be changed, except for matters otherwise specified by law or this Policy. The revised Privacy Policy will take effect when it is either notified to Users by a method prescribed by the Company or posted on the Company’s website.
12 (Compliance with Laws and Regulations)
The Company will comply with Japanese laws and other regulations applicable to the personal information it holds.
13 (Response to Complaints and Inquiries)
The Company accepts complaints and inquiries from Users regarding the handling of personal information and responds appropriately and promptly. Furthermore, the Company will respond promptly and appropriately to User requests for disclosure, correction, addition, deletion, suspension of use, or refusal of provision of their personal information.
14 (Security Measures)
The Company takes organizational, physical, personnel, and technical measures to prevent unauthorized access, loss, destruction, alteration, and leakage of personal information. These measures include implementing access restrictions, recording access logs, and adopting security measures against external unauthorized access. In the event of an incident involving the leakage of User personal information, the Company will promptly report it to the supervisory authority following the Personal Information Protection Act and related guidelines and will take necessary actions, including preventive measures.
